Para 27: Defence lawyers, do not let a judge stop you from asking police witnesses about their knowledge of the applicant’s rights in a 24(2) application voir dire. An officer, who violates a Charter right while knowing better, commits a flagrant breach
Para 36: Under the second 24(2) Grant factor, it does not lessen the invasion of privacy if the police do not disturb anyone when they illegally enter a residence. At best, it represents the absence of a further aggravating factor.
Para 54: Defence lawyers, a note potentially favouring release during the COVID-19 pandemic. The Appellant did not have to surrender into custody the night before his appeal hearing, which his bail required. The hearing was back on March 10, 2020.
