1. #TravelTuesday #PackageHolidays #Refunds #Vouchers *It is clear that some of you #TravelCompanies are determined to disrupt my work programme today and I suspect other days! It is frankly like #FredCarneysCircus out there for Consumers. Quite clear that @ABTAtravel & others..*
2. *..are not going to take up my offer to help them define a voucher scheme that is fair to #TravelCompanies but equally fair to #Consumers. I did so b/c pragmatism is required but it also recognises perhaps the dire state of finances that exists in those companies B4 #CV19..*
3. *..So, I've previously done a 'live' #Radio interview with @bbchw, with a #Consumer who had a #Coach #PackageHoliday. After some 'deliberation', the company agreed to follow the #PackageTravelRegulations and refund her money; so far so good! Now, b/c she hadn't received her..*
4. *..promised cash refund, she chased them, and was told, no, you're not getting your money back, you're getting a voucher valid for 12 months, full-stop! Ouch! But I say to this company, based on the south-coast of #England, not good enough! You cannot renege on your...*
5. *..obligations contained within Regs 13 & 14 (whatever about Reg 12) of #PackageTravelRegulations just b/c it doesn't suit your bank balance. Also, Clause 8 of your Ts&Cs makes clear that the #Consumer will get their money back where the holiday has been cancelled, and..*
6. *..absolutely no mention of any 'alternative' #voucher offering within their Ts&Cs ( #Consumers following this thread, save a copy of your company's Ts&Cs b/c these are the ones valid to your contract - they may try to change them!). So, I say to this #TravelCompany...*
7. *.."What on earth are you up to?". This is an example of the "Wild-West" that some #Travel professionals are reporting. Trade bodies are fixated with a questionable legal change by @GOVUK when a simple solution can be deployed, which everyone can perhaps accept..*
8. *..So in absence of anyone contacting me 2bring order to chaos; in recognition that #Consumers are out there struggling 2get any sense out of these #TravelCompanies, I think it might be an idea 2create grounds/basis of when #vouchers 4 #PackageHolidays may be offered/accepted*
9. *1) The voucher must recognise the validity and applicability of all of the rights under the Package Travel Regulations to your holiday contract and that the company is holding any Consumer monies paid for that contract on Trust for that Consumer*
10. *2) The voucher or credit note must recognise that you have a right to refund under the current circumstances, under Regulation’s 12, 13 & 14 of the Package Travel Regulations*
11. *3) The voucher should only initially be valid for 12 months, but subject to advices from different governments or trans-national bodies, can be extended in writing, with all the existing conditions, by mutual agreement for a further defined period*
12. *4) If the voucher is extended, but new conditions are added to which the Consumer does not agree, then the Consumer is entitled to a full refund as set out in the Package Travel Regulations*
13. *5) The voucher must confirm that the monies that the Travel Company holds is financially protected (with verifiable details), if not, then the voucher cannot be offered and the full rights to a refund must be given*
14. *6) The voucher must state that you can demand the return of your monies at any time during the validity of the voucher, from the point of it being offered, being received, up to the end-date of validity*
15. *7) The issuer of the voucher must inform the recipient of the voucher of any material changes to its financial protection cover, its operations or inability to perform any of its operations*
16. *8) Any request for a refund during the lifetime of the voucher must comply with Regulation 14 (3) of the Package Travel Regulation*
17. *9) It should state the voucher's purpose is not defeated by the company's terms & conditions and that the voucher's issue is a variation of those terms & conditions agreed at the time the contract was made. In any event, neither override/defeat #PackageTravelRegulations*
18. *These are simple #confidence building measures that #TravelIndustry could uniformly deploy, but they appear to be trapped in their own headlights. #Consumers, could make these args; Usual caveat: Be sure this is for you, always seek legal advices, this is just a suggestion!*
