As one of the lawyers representing a number of Wisconsin GOTV and other organizations who brought the lawsuit over next Tuesday’s election, I have been getting a lot of questions about process and timing of the appeal to the Supreme Court. I will clarify. 1/
First, the Applicants in the case (RNC, RPW, Legislature) filed an emergency application to the US Supreme Court yesterday afternoon. The Respondents include the Wisconsin groups I and other lawyers represent, plus the DNC and DPW. We were instructed to file a single brief. 2/
Our combined responsive brief is due today by 1 PM CDT. The application will go to the Supreme Court Justice for our Circuit (the 7th Circuit), which is Justice Kavanaugh. By rule, he may either rule on the application on his own, or he may refer it to the entire Court. 3/
The Applicants have asked for a ruling on the Application no later than tomorrow, which is Monday, April 6, the day before the Tuesday election. A ruling could come any time after we submit our response today at 1 PM CDT and before the end of the day tomorrow. End.
