His issue is the dangers of SOE & capabilities of Emergency Powers Act.
The Presidency is a powerful office in Botswana. Different scholars have presented research articles demonstrating that the Botswana President wields enormous powers, compared to other jurisdictions.
Under the SOE, the President assumes additional powers, some of which allow him to assume all the powers of Parliament. The President is permitted to make new laws, amend existing laws and suspend some laws (Emergency Powers Act).
The question is, could the lockdown be effected without declaring a SOE in accordance with section 17 of the constitution? Should Parliament meet and basically authorise rule by decree for 28 days?
Does the fight against Corona require the President to rule alone and suspend the constitutionally established governance processes? Beyond suspending our freedom of movement, do we need to suspend structures of good governance?
