For me, as a chronically ill, disabled patient and healthcare lawyer this policy proposal is deeply, deeply concerning. https://twitter.com/KamalaHarris/status/1199009980751503361
Sen. @KamalaHarris' plan calls for "Repeal[ing] the Institutions of Mental Disease (IMD) exclusion"

Here's Jennifer Mathis of @BazelonCenter writing in @APAPubPsychSvcs explaining why repealing the IMD exclusion is a bad idea:
https://ps.psychiatryonline.org/doi/full/10.1176/appi.ps.201800413
I disagree that the path forward should be locking more people up in institutions, instead I completely agree with Att'y Mathis' analysis here:
Sen @KamalaHarris also proposes that the HIPAA Privacy Rule, the federal regulation guaranteeing patient privacy, should offer those of us with a mental health diagnosis less protection, less privacy, less safety.
Imagine for a moment, an 18 year old trans kid who is a senior in high school. They live at home with their 'parents' who relentlessly torment & abuse them.

But bc they're 18, they know they can seek out medical care on their own.

You see the problem, right?
Sen. @KamalaHarris' proposal to eviscerate HIPAA would have made it impossible for me to protect @whyrntulaughing. https://twitter.com/whyrntulaughing/status/1199127023836442624?s=20
I want to be clear about something:

HIPAA does not bar me, as a patient with mental health diagnoses, from authorizing my clinicians to share information with my family **if I so choose**

This is one version of a Designation of Personal Representative doc that does just that:
If you've spent time as a patient in healthcare settings, you may very well be familiar with other HIPAA release instruments.

The point here is that it should be up to the individual whether information is disclosed, and if they want it disclosed? Great, we can make that happen
The choice should be mine. I should not enjoy a lesser standard of privacy, a lesser standard of protection, a lesser standard of safety because I have a mental health condition.

WE'VE BEEN FIGHTING FOR PARITY FOR DECADES
This plan is astonishingly bad, and Sen. @KamalaHarris should withdraw it https://twitter.com/cosetthetable/status/1189608477557252096?s=20
