Even if it includes more children than tribunal order, class actions are deployed against Indigenous peoples primarily to address historic wrongs and to prevent future liabilities from their legacy. It is ill-suited to address an ongoing crisis based on current Crown conduct.
You can look to the 2018 sixties scoop class action as a recent example of what the federal government is looking for. It provides an estimated $25K to a defined class of survivors, and has the certainty of being released of liability for its conduct.
