Unions advocated for some of the early laws protecting workers from retaliatory discharge. Workers even suspected of organizing a union were frequently fired for their “disloyalty.”
The 1926 Railway Labor Act made it illegal for RR to retaliate against employees for peaceful union activities.
The Wagner Act prohibited employers from discriminating/retaliating against workers for their union activity. It also established the National Labor Relations Board to enforce the law. Workers could not be discriminated against for participating in NLRB enforcement proceedings.
These laws laid the groundwork for the concept of a whistleblower: a worker who resists unethical/ illegal behavior at work. Whistleblower law is designed to protect workers from having to decide whether they will earn a living or commit crimes.
