One year ago today, my favorite legal decision of all time was announced: my win over ESPN.

I’m going to celebrate it today with some behind the scenes details of the ordeal in this thread.

Fun fact: in 2012, I practiced Insurance Defense working at my uncle’s lawfirm, until I was forced to leave (it’s a long stupid story that divided my family...haven’t spoken to him since)

Thanks to @OldTakesExposed tweeting out a blog article of my win, a number of major sites picked it up, which is still surreal to me.

The whole ordeal started because one of my personal twitter followers had developed a near 300k rip off notsportscenter Instagram (pictured) screenshotting my tweets

(he actually would DM me asking me to write jokes about certain things, which he later posted to this crap page)
I filed hundreds of DMCA notices on it trying to get it down. Instagram wouldn’t give it to me.

So i applied to trademark my name. As soon as I did that, they gave it to me instantly. 🤦‍♂️

Well, that pissed ESPN off, which led to a very threatening cease and desist letter.
I had hired a trademark attorney to file the mark (I’m not a member of the patent bar, so I didn’t want to screw it up).

He told me not to respond, so I didn’t, despite that they gave me a week to hand over literally everything with the NOTSC name on it. Nothing happened.
A year later, a new attorney emailed me “wanting to talk”. I had let the trademark application lapse after getting my IG name, so I figured there was nothing to talk about.

Within a week, he went from wanting to talk to also threatening me...before I had even responded to him.
I again did nothing.

This guy then filed the UDRP claim against http://notsportscenter.com . I haven’t used it in almost 4 years since I promote other websites now.

So as a settlement, I offered to give them the domain if they agreed to leave me alone and drop the other threats.
That’s right, I offered to GIVE them the website they fought me over, and they didn’t take it.

He turned it down, saying they “disagreed” with all of my settlement letter (which mostly stated facts 🤦‍♂️).

He was a UF law alum, so I guess he was eager to lose to FSU again.
So after they declined my one settlement offer, I had to file a response brief to their complaint.

As part of my response, I had to establish that I had been planning to use the website for a long time, so I included this as evidence. Check the one from @RobLoweSports lmao
In my first response I made random cracks about things, and take shots at the lawyer (and ESPN)...here’s some highlights

I said I can’t use …http://someotherwebsitethatdoesntmakesense.com  (one of my favorite lines)

Mocked the lawyer for contradicting himself

Ripped ESPN for doing nothing for so long
So after I filed my response, I thought i was done. I ripped to shreds their garbage complaint...and I thought that would be the end.

Well, literally on the last day possible, they filed an additional complaint.

This is when shit got truly ridiculous, and in turn, so did I.
In their 2nd complaint, ESPN basically tried to argue the following

-They were known for humor
-They owned the word “Not”
-Nothing I did was a parody
-I made up that I formed NOTSportsCenter, LLC in 2013 because I didn’t include evidence that showed I did (lmao desperate much)
In my 2nd response, I was pissed (hence all the bold), because I had 5 days to write a 20 page response.

Ripped them saying “we put your tweets on TV by accident” (5 times?)

Took a shot at ESPN getting political...even had to explain what “Lmao” meant, which cracked me up.
My favorite part was this section.

They argued nothing I did was parody or made fun of ESPN, so boy did I pile on to show I did. Read these.

The lawyer lists on his firm’s page he’s a member of MENSA.

So I said “it doesn’t take a member of MENSA to see this is clear parody” 😬
Some of my favorite pieces of evidence from the 2nd response, since I had to both establish I wasn’t SportsCenter and that I made fun of it.

I actually used a giant graphic of Daniel Tosh saying ESPN was “72% jerking off the SEC” as evidence AGAINST ESPN, which I just loved.
That wraps the thread. There was plenty more (like 70 pages of legal briefs). I’m sure the panel didn’t even want to read it all.

I offered ESPN what they wanted, then shoved it in their face as I ripped their heart out via legal briefs while mocking them. Living the dream lmao
