It's been a slow Monday morning at the office (thankfully) so I decided to read Section 25 of the South African Constitution.
A cursory reading of this document leads me to think that if it is changed to allow expropriation without compensation then SA is FUCKED beyond saving.
I suspect sub-section 2b will be the part which will be amended:
(2) Property may be expropriated only in terms of law of general
application—
(a) for a public purpose or in the public interest; and(b) subject to compensation, the amount of which and the
time and manner of...
of payment of which have either been
agreed to by those affected or decided or approved by a
court.
The devil is in the details.
Sub-section(4)
For the purposes of this section—
(a) the public interest includes the nation’s commitment to
land reform, and to reforms to bring about equitable
access to all South Africa’s natural resources; and
(b) property is not limited to land.
If they amend sub-section 2(b) to allow expropriation without compensation (EWC) but they do not amend section 4(b) in some way which limits EWC to land only then it means the state can take ANYTHING you own.
Don'think they won't do it.
The land issue is highly emotive & once again the people will be manipulated based on their legitimate grievances.
Without appreciating the facts, they will be voting against their interests yet again.
Why is the sub-section 4(b) issue not on the front page of all the papers?
People will be in effect voting to allow the government the power to take everything that everyone owns.
The mental gymnastics which requires a person to truly believe that the government will represent the electorate's interests instead of their own are ASTOUNDING.
With all the clear evidence of government corruption, how can the SAn public be so wilfully ignorant about the consequences of allowing the government this much power?
Do you really think that once the state has the ability to do this that they won't abuse this power?
If you think this is just someone trying to protect their "land" then ask yourself honestly whether you really trust the same people responsible for Marikana and the Life Esidimeni scandals to protect the dignity of black people?
Why wouldn't they abuse this power, when there is so much evidence that they have abused their power in everything they've touched?
Do you not understand that one of the best things about democracy is that it helps people to dislodge power from the state?
